Legal question, time share, double deeded to one property without permission?
Posted on Feb 17, 2010 under Disney Time Share | 1 CommentI have a property in florida by the walt disney attraction park. For years i havent used it and have booked it with rci to exchange it. now i want to get rid of the property but i can’t get rid of it because myself and some other random person have both been issued to the exact same timeshare. I would be willing to let them have it but the Time Share said that i would have to pay some fee’s. so i payed the fee, now they still will not remove my name from the time share because of the conflict and are now pushing a $1600 fee on me. Do i have a legal right to take this to court and possibly sue. I personally have never wanted to sue anybody, but if a big corparation is going to push fees on me for their mistake i feel i should have some rights.
The best option is to find a real estate attorney that specializes in timeshares & title transfers in Florida. They can better tell you what to do.
In preparation, be sure to date & document everything like the communication to pay for the initial transfer and the new $1600. You should ask the attorney if the initial dual person deed was in fact legal in the first place.
You may not need to sue except to recoup legal fees…it may end up more trouble than it’s worth. There may be some basis for a lawsuit for putting another person on the same deed. Again, you’ll need to speak to a legal professional about this.
